Summary Action to require the state to provide Medicaid reimbursed PAS to an individual in a reliable, unarbitrary way in order to prevent unnecessary institutionalization. An ADA claim was not raised. The state volunteered to increase provider reimbursement rates & the P&A; pursued this at a policy level after the plaintiff moved before the court could rule. Progress Case dismissed.
