Mandy R et al v. Owens et al *

Date filed: Aug. 2000
Case status: Open
Primary Target group:
Case Type (Olmstead e or Related f): Olmstead
Reference (on the Olmstead & Olmstead-related Lawsuits table) : CO23
Case Summary & Links to Further Details iii:
Summary Case (class action denied) challenges waitlists and seeks ICF/MR services in small community group homes. An association of non-profit community services providers contended that state payments for HCBS are inadequate & waiver services should be expanded, not ICF/MR services. Court dismissed plaintiff's ADA claims, on grounds that "Olmstead does not stand for the proposition that a state must create, expand or maintain programs for the purpose of preventing disabled individuals from becoming institutionalized". Progress Trial held (Jun 2004) but no decision announced. Further details [http://www.thearcofco.org/current.html]
